Doc wins round in police brutality claim
ATLANTA (AP) - A Florida physician has won his day in court on a claim of police brutality stemming from an overheated car in the parking lot of his walk-in clinic.
A panel of the 11th U.S. Circuit Court of Appeals ruled Thursday that a federal judge wrongly granted qualified immunity against the lawsuit to Hillsborough County Sheriff's Officer Henry Bruce.
Dr. Adolfo Galvez claimed his rights were violated when Bruce handcuffed him and slammed him into a wall, cracking two ribs and causing a leaking aneurysm, as he was arrested at the Brandon, Fla., clinic on Sept. 20, 2004.
Bruce was dispatched to the scene to settle a dispute that arose after a teenage girl pulled her overheated car into the parking lot.
